Terms of Service

OC Maker AI provides online AI tools that generate and edit original character (OC) artwork and short videos from text prompts and reference images. By accessing or using ocmakerai.org (the "service"), you agree to these Terms of Service. If you do not agree, do not use the service.

OC Maker AI is an independent platform. It is not affiliated with, endorsed by, or sponsored by any anime studio, game publisher, or franchise whose art styles inspire fan-made original characters.

1. The service
OC Maker AI lets you create original character art (text-to-image), edit existing images using reference images for character consistency (image-to-image), and animate images into short videos (image-to-video). Available models, styles, and features may change as the service evolves.

2. Accounts and access
You may be able to try the service with free trial credits without an account. To buy or hold paid credits you need an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 13 years old to create an account. We may suspend or terminate access if we detect fraud, abuse, illegal activity, or behavior that harms the platform or other users.

3. Credits and payments
Credits are prepaid units that are consumed by generations. Credit packs are billed through our payment processor at the prices shown at checkout; taxes may apply. Credits are a limited, revocable license to use the service — they are not property, hold no cash value, are non-transferable, and cannot be exchanged for cash except as described in our Refund Policy. Unused credits do not expire while the service is operating, but we do not guarantee any specific generation speed, model version, or feature availability.

4. Acceptable use
You may use the service only for lawful purposes and only with prompts and images you have the right to use. You may NOT use the service to:
- create sexually explicit (NSFW) material, and specifically any sexual or suggestive content involving minors — this is strictly prohibited and results in immediate account termination;
- create deepfakes or impersonate real, identifiable people in ways that are deceptive, defamatory, sexual, or otherwise harmful;
- sell or commercially exploit renders of existing copyrighted characters or franchises — original characters "inspired by" an art style for personal fan use are your responsibility to keep within the rights of the underlying rights holder;
- create content that is unlawful, hateful, harassing, fraudulent, or that violates privacy, publicity, copyright, or other third-party rights;
- attempt to reverse engineer, scrape, resell, overload, or disrupt the service or its infrastructure.

5. Your content and uploads
You retain ownership of the prompts and images you upload. You grant OC Maker AI a limited license to host, process, transmit, and store that content solely to operate, secure, support, and improve the service. Do not upload images you do not have the right to use.

6. Generated output
AI-generated outputs vary based on prompts, references, and model behavior. Review every output before using, publishing, or sharing it. Do not rely on generated media for legal, medical, identity, or safety-critical purposes. Subject to these Terms, you may use the images and videos you generate for personal and commercial projects; you are responsible for ensuring your use does not infringe the rights of any third party or franchise.

7. Availability and changes
We may update, improve, limit, or discontinue any feature at any time. We do not guarantee uninterrupted availability or permanent storage of uploaded files, generation history, or outputs unless explicitly stated.

8. Disclaimer of warranties
The service is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free service.

9. Limitation of liability
To the maximum extent permitted by law, OC Maker AI and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, profits, or goodwill arising from your use of the service. Our total aggregate liability for claims relating to the service is limited to the amount you paid us in the twelve months preceding the claim.

10. Termination
You may stop using the service and delete your account at any time. We may suspend or terminate your access for violation of these Terms, with or without notice where we reasonably believe it necessary to prevent harm or legal liability.

11. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles.
